Borrowing from a moneylender legally, in four checks

Written by the Loankira editorial desk — Malaysian finance writers, every figure checked against BNM, LHDN, KWSP or PERKESO · Last reviewed: 13 October 2026

Licensed moneylenders are firms authorised under the Moneylenders Act 1951 to lend at capped statutory rates; an unlicensed lender sits outside that cap and outside the register you can check.

Licensed moneylenders are legal, capped and verifiable in minutes. Unlicensed ones are none of those. Four checks before you sign anything.

Check the licence — it is public

Legal moneylenders are licensed under the Moneylenders Act and regulated by KPKT (the Ministry of Local Government Development). Every licensed operator has a licence number and registered business premises, both verifiable via KPKT's eServices portal or the state housing board. No licence, no loan — unlicensed operators ('along') charge whatever they like and enforce it informally.

The legal interest caps

The Act caps interest at 12% per annum on secured loans and 18% per annum on unsecured loans. Anyone advertising more is either not licensed or burying fees; ask for the effective annualised cost including every charge in writing. Note the caps apply to the moneylending company, not to banks' products or cooperative loans governed by other rules.

The contract must-haves

A proper moneylending agreement states: principal, interest rate and how it is computed, every fee, the repayment schedule, default terms, and the licence number. Insist on a copy signed by both parties and receipts for every payment — bank transfer to the company account, never to a personal account. The receipt trail is what protects you in any later dispute.

When a moneylender is the right tool

Honestly evaluated: if you can qualify for a bank or cooperative loan, that is almost always cheaper. The licensed moneylender route earns its place for speed (same-day small amounts), thin-file borrowers, and short bridging gaps — used for months, not years. Before signing any fast-cash offer, price the same amount against your credit-card instalment plan; it is frequently cheaper and instantly available.

How to verify a licence in five minutes

Ask for the company name exactly as registered, then check it against the Moneylenders Act list published by KPKT and the state register; licensed entities also appear on Bank Negara Financial Consumer Alert page for loans. Cross-check the SSM profile for an active status and the directors named. Then ask two questions before any payment: the effective interest rate in writing, and whether early settlement uses the Rule of 78 or a rebate formula. A licensed lender answers both without hesitation; pressure to decide today is the loudest warning in the sector.

Reading the agreement: the five clauses that matter

One: the effective rate and the total amount repayable, not just the flat figure. Two: the default provisions, including any rate uplift and the notice period. Three: post-dated cheques or auto-debit authorisations, and what happens if an instalment fails. Four: the assignment clause, whether the debt can be sold to a collector, and who may then contact you. Five: the termination and rebate schedule. Photograph every page including the schedule; disputes later are won by documents, not memory.

Frequently asked questions

Are licensed moneylenders legal in Malaysia?

Yes. Moneylending is a licensed activity under the Moneylenders Act 1951, administered by KPKT through the state registries. Verify the licence before signing anything.

What interest rate can licensed moneylenders charge?

Personal-loan rates are capped by the Moneylenders Act framework (historically 12% to 18% per annum depending on the type of loan) and must be disclosed. Ask for the effective rate and total repayment in writing.

Do licensed moneylenders affect my CCRIS record?

Only if they report or if the debt is assigned and litigated. Many smaller licensed lenders do not report to CCRIS, which is why an unlisted debt can still surprise a bank enquiry later; list all debts when you apply.
