Saying 'I'll guarantor it' is taking a loan you cannot see

Written by the Loankira editorial desk — Malaysian finance writers, every figure checked against BNM, LHDN, KWSP or PERKESO · Last reviewed: 22 October 2026

A guarantor is a second party liable for the whole debt if the borrower defaults, and the obligation sits in the guarantor's own credit record until it is released.

Guaranting a loan is underwriting someone else's debt with your record. The pursuit order, the CCRIS effect, and the exits - before you ink.

What you actually sign up to

A guarantor is a full contingent borrower. If the primary defaults, the lender's claim lands on you without renegotiation: the outstanding principal, accrued interest, and often penalties. For hire-purchase and personal guarantees, this can mean the lender seizing the financed asset and pursuing you for the shortfall. Sign only amounts you could service yourself on your current income — that is the honest test.

It shows on your record and caps your capacity

Guaranteed facilities appear in CCRIS and are counted in your commitments when you apply for your own loan. A RM300,000 guarantee can quietly absorb the DSR headroom your own home purchase needed. Before signing, model both scenarios with a DSR calculator: your commitments with and without the guaranteed loan.

The lender's pursuit order

Do not assume 'they chase the borrower first.' Under theContracts Act and banking practice, after default and notice many lenders proceed against whichever party is easier to collect from — frequently the guarantor with the stable salary. Limited guarantors (cap amount or asset-backed) exist; unlimited guarantees do not. Negotiate the scope before signing, not after.

Protective moves before you ink

One: put a ceiling on the guarantee. Two: require written notice of default and a cure period before the lender calls you. Three: ask the lender to confirm, in the offer letter, the release conditions — full settlement, refinancing, or substitution. Four: keep copies of every statement; on settlement, obtain the discharge/release letter and verify the CCRIS entry clears within 90 days. A guaranty that ended should not shadow your next application.

Guarantor vs co-borrower: the liability differs

A co-borrower applies with you and is liable from day one as a primary debtor; a guarantor liability is contingent and shaped by the guarantee wording. The difference shows at separation or death: a co-borrower simply continues the instalments, while a guarantor exposure depends on whether the guarantee is continuing or limited to a named facility and amount. Read the guarantee clause in the offer letter; a continuing guarantee survives refinancing and top-ups, which is exactly when unexpected exposure appears.

Divorce, death and business partners: the three common blow-ups

Family: a parent guaranteeing a child hire purchase can find the guarantee blocks their own refinancing years later, because CCRIS still counts the commitment. Marriage: guarantees between spouses or in-laws survive divorce until formally released; ask the bank for a release letter, not a verbal assurance. Business: partners guaranteeing each other create circular exposure, where one default triggers demand letters to every guarantor. In all three the fix is a written release or substitution at the bank, done while the account performs.

The guarantor own loan application: a worked ceiling

Take a bank with a 65% DSR cap and a guarantor earning RM7,000 with RM1,800 of commitments, asked to guarantee a RM2,300 per month car loan. The bank counts RM4,100 of RM4,550 capacity; the guarantor own home-loan eligibility drops from about RM5,200 of instalment to roughly RM2,900 at the same rates, before their own application is even submitted. Decide with the calculator open, not at the dealer desk.

Frequently asked questions

Can a guarantor be removed from a loan?

Only by the lender, in writing, typically via substitution or release once the account has performed and the remaining borrower qualifies alone. Keep the release letter; CCRIS updates follow the bank reporting cycle.

Does being a guarantor affect buying my own house?

Yes. Guaranteed instalments count in your DSR when you apply, reducing the loan you qualify for. Some banks exclude guarantees where the primary account is clean; ask instead of assuming either way.

Is a guarantor liable immediately if the borrower misses one payment?

Lenders usually pursue the borrower first, but demand can be made of the guarantor once default procedures begin, per the guarantee terms. No law forces the bank to exhaust the borrower first; read the clause.
